Fees and first steps

Will I talk to an attorney or a paralegal?

An attorney. Every client works directly with an attorney from the first call. There's no call center and no paralegal screening.

How does a first consultation work?

Every matter starts with a consultation. Call us at (615) 555-0142 or request one online, and you'll speak with the attorney who handles your kind of matter. We'll listen, explain your options and tell you how the work would be billed.

What do you charge a flat fee for?

Most estate plans and business formations. Starting at: will package $950 individual / $1,450 couple; revocable living trust package $2,800 individual / $3,400 couple; LLC formation with operating agreement $1,250; corporation formation with bylaws $1,650.

What's billed hourly?

Probate, family law and litigation are billed hourly. We don't list hourly rates online; we'll explain how billing works at your consultation, before you commit.

Where are you, and which areas do you serve?

We're at 412 Main Street, Suite 200, in downtown Franklin, open Monday to Friday, 8:30 to 5:30. We serve Franklin and the greater Nashville area: Williamson, Davidson, Maury and Rutherford Counties.

Planning or settling an estate

What does an estate plan cost?

Most estate plans are a flat fee. Our will package (will, powers of attorney and healthcare directive) starts at $950 for an individual or $1,450 for a couple. Our revocable living trust package starts at $2,800 for an individual or $3,400 for a couple. Every matter starts with a consultation, and you'll know your price before you commit.

Do I need a will or a trust?

A will says who receives your property and who cares for minor children, and it goes through probate after you die. A revocable living trust holds your property during your lifetime so it can pass to your family without probate, and it keeps more of your affairs private. It costs more to set up. Which one fits depends on what you own, your family and your goals. We'll give you a straight recommendation at your consultation.

What's the process, and how long does it take?

We meet, agree what your plan needs and confirm the flat fee, then draft your documents for you to review. Once you're happy, you sign them with us. How long it takes depends mostly on how quickly decisions get made; we'll give you a realistic timeline at your first meeting.

What does probate involve in Tennessee?

Probate is the court-supervised process of settling someone's estate. In general it means filing the will with the probate court, having a personal representative (executor) appointed, notifying creditors, paying valid debts and taxes, and distributing what's left to the people entitled to it. We'll walk you through each step as it comes.

A parent has died. What should I do first?

Find the will if there is one, keep the house and belongings secure, and hold off on paying debts or handing out property from the estate until you've spoken with an attorney. Then call us. We'll tell you what needs to happen first and what can wait.

How long will probate take?

It depends on the estate: what it holds, whether there's a valid will and whether anyone disagrees. After we've reviewed the details we'll give you an honest estimate, and we'll keep you updated as things move.

Divorce, custody and mediation

Is mediation or collaborative divorce an option for us?

Often, yes, especially when both of you want to avoid a court fight. Mediation uses a neutral mediator to help you reach your own agreement. Collaborative divorce gives each of you your own attorney, with everyone committed to settling outside court. Rachel Moreno is a Rule 31 Listed Family Mediator and will help you decide which route fits.

How is custody handled in Tennessee?

When parents with minor children divorce in Tennessee, the court approves a permanent parenting plan that sets out the residential schedule and how major decisions are made. Parents can agree on the plan themselves, often through mediation; if they can't, the court decides based on the child's best interests.

Who will I be working with?

Rachel Moreno, directly. There's no call center and no paralegal screening your call. She'll be your attorney from the first conversation.

How is family law billed?

Family law matters are billed hourly. We'll explain how billing works and what affects the total at your consultation, before you commit.

Small business

Can you form my LLC, and for what flat fee?

Yes. LLC formation with an operating agreement starts at $1,250. Corporation formation with bylaws starts at $1,650. Every matter starts with a consultation, and you'll know your price before you commit.

Can you review contracts and leases on an ongoing basis?

Yes. We offer ongoing counsel for businesses with 5 to 50 employees, so you have a lawyer to call when a contract, lease or question comes up. We'll talk through how that works for your business at your consultation.

Do you handle succession planning?

Yes. James Austin handles business succession planning, and because it overlaps with estate planning, he can plan both together.

Should I form an LLC or a corporation?

It depends on how you plan to own, run and grow the business, and on tax considerations you should discuss with your accountant. Many small businesses choose an LLC for its flexibility. We'll walk you through the trade-offs at your consultation.

Real estate

Who will handle my closing?

For a home, usually Elena Whitfield, a former title-company closer who handles most of our closings. For commercial property, David Okafor.

Can you review a commercial lease before I sign it?

Yes. David Okafor reviews, drafts and negotiates commercial leases for business tenants and landlords.

What if a title problem turns up before closing?

Call us as early as you can. We review title, work through boundary and ownership issues, and try to resolve them before they put the sale at risk.

What does real estate work cost?

It depends on the property and the work involved, so we don't publish real estate prices. Every matter starts with a consultation, and we'll tell you how your matter will be billed before you commit.
