Mediation and collaborative divorce

In mediation, a neutral mediator helps you and your spouse reach your own agreement on property, support and parenting. Rachel Moreno is a Rule 31 Listed Family Mediator, listed under Tennessee Supreme Court Rule 31 to mediate family cases.

In a collaborative divorce, each of you has your own attorney, and everyone commits to working out a settlement together instead of going to court.

Both routes are usually calmer and more private than litigation, and both keep the decisions with you. We'll help you decide whether either one fits your situation.

Questions we hear

More answers on our FAQ page.

Is mediation or collaborative divorce an option for us?

Often, yes, especially when both of you want to avoid a court fight. Mediation uses a neutral mediator to help you reach your own agreement. Collaborative divorce gives each of you your own attorney, with everyone committed to settling outside court. Rachel Moreno is a Rule 31 Listed Family Mediator and will help you decide which route fits.

How is custody handled in Tennessee?

When parents with minor children divorce in Tennessee, the court approves a permanent parenting plan that sets out the residential schedule and how major decisions are made. Parents can agree on the plan themselves, often through mediation; if they can't, the court decides based on the child's best interests.

Who will I be working with?

Rachel Moreno, directly. There's no call center and no paralegal screening your call. She'll be your attorney from the first conversation.
